The jury on the trial of the guy who threw a sandwich at the police is in deliberations and just... this case is so screwed up.
They're not claiming battery so they don't have to show proof of actual injury. They're claiming assault and that the defendant intended to cause injury. With a sandwich. That he threw. At an armored man with a gun. They could not establish what the intended injury was short of "mustard stains".
The "victim" even admitted on the stand he found the whole thing funny and keeps a plush sandwich on his desk now.
This is textbook selective, capricious prosecution. But we all knew that.
Oh and yeah, a federal grand jury refused to indict this guy, so they just went and charged him at a high misdemeanor level instead, ugh.

@elfi Yeah. A grand jury refused to indict on felony charges 3 times, so they charged him with a bunch of misdemeanors that'd add up to jail time anyway. And got through the entire trial because once in front of a judge the case spun on "Did he intend to hurt someone?" which is such a subjective thing a judge can't rule on fact alone there.
However a judge can rule that no reasonable jury would find guilty and make a directed verdict, and he should have.
And the case should not have been brought and that it was is a flagrant abuse of police/prosecutor authority (obviously, no shock here, ACAB and all).
It all sucks.
